THIS IS A FOLLOW UP TO THE NUISANCE NOISE ORDINANCE THAT THE COUNCIL SPENT A LOT OF TIME CRAFTING IN THE LAST YEAR OR SO. THE NUISANCE SAW COVERS EVERYTHING THAT HAS TO DO WITH NOISE. THERE'S A COUPLE OTHER THINGS THAT ARE TRADITIONALLY PART OF DISTURBING THE PEACE. DISORDERLY CONDUCT, ORDINANCES THAT AREN'T NOISE RELATED. SO THIS IS SPECIFICALLY FOR THOSE THINGS. THESE CONDUCTS ARE ALREADY ILLEGAL AT SOME FORM, WHETHER IT BE A STATE ORDINANCE, A STATE LAW, OR IN OUR CURRENT LAW. SO WE AREN'T PROHIBITING ANY NEW BEHAVIORS. PUTTING IN A CLEANER ORDINANCE AND CLARIFYING WHAT THE PUNISHMENT WILL BE. SO THE DISORDERLY CONDUCT ORDINANCE WOULD SPECIFICALLY PROHIBIT. WHERE DO I GO WHERE FIGHTING, THREATENING, TAUNTING AND SIMILAR DISORDERLY BEHAVIOR BUT ALSO PREVENT PROHIBIT BLOCKING THE SIDEWALK, AS WELL AS INTERFERING WITH THE IDAHO FALLS REGIONAL AIRPORT OPERATIONS. IT ALSO MAKES THIS ORDINANCE AN INFRACTION WHICH WOULD BE PUNISHABLE BY A FINE. THERE IS [00:05:05] AN ESCALATOR IN. IT IS IF YOU'RE INTOXICATED WHEN YOU VIOLATE THE ORDINANCE, THAT WOULD MAKE IT A MISDEMEANOR. ALL RIGHT. SO ACTUALLY THE CHIEF HAS THREE ITEMS IN HERE. SO LET'S GO. GO AHEAD AND EXPLAIN ALL OF THEM. AND THEN WE'LL DO THREE ACTIONS. OKAY. THE NEXT. YES. DO YOU WANT TO DO THAT NOW OR AFTER THE THREE. IT GO AHEAD. WE'VE HAD A LOT OF, I THINK, MOSTLY POSITIVE OPPORTUNITIES FOR PEOPLE TO KIND OF PROTEST ON THE BRIDGE ON BROADWAY. AND WHEN THIS MADE ME BLOCKING THE SIDEWALK, MADE ME WORRY THAT THAT MIGHT PUT THEM AT RISK OF THAT IN THIS ORDINANCE. SO ALREADY PROHIBITED TO BLOCK THE SIDEWALK. SO CURRENTLY THOSE PROTESTERS CANNOT BLOCK FREE MOVEMENT OF TRAVEL. THEY CAN'T BLOCK THE SIDEWALK. SO THAT'S NOT ANY DIFFERENT. THEY JUST NEED TO LEAVE SOMETHING CORRECT. AND USUALLY WHEN A PROTEST HAPPENS, MOST OFTEN THEY'LL CALL THEM AND TALK TO US BEFOREHAND. AND WE EXPLAIN TO THEM THEY CAN'T BLOCK ROADS, THEY CAN'T BLOCK SIDEWALKS, THINGS LIKE THAT. AND MOST OF THEM TRY REALLY HARD TO COMPLY WITH THAT. OCCASIONALLY WE HAVE TO GO DOWN AND TELL A PROTEST GROUP THAT THEY HAVE TO ALLOW PEOPLE TO GET THROUGH ON THE SIDEWALK. THAT DOES NOT CHANGE. SO THAT IS ALREADY INHIBITED. YES, PROTEST GROUPS WOULD HAVE TO ALLOW FOR PEOPLE TO PASS AND WE'LL HAVE FREE TRANSIT. BUT I JUST TO CLARIFY, IT'S A PUBLIC SIDEWALK IS SOMEPLACE WHERE PEOPLE CAN STAND AND DO THAT. THEY JUST CAN'T BLOCK IT. CORRECT. MEANING PROHIBIT TRYING TO PREVENT SOMEONE FROM MOVING. OKAY. AND I'VE BEEN DOWN TO A LOT OF THOSE PROTESTS. AND ALMOST ALWAYS THEY'RE THEY'RE DOING THEIR BEST TO FOLLOW THAT LAW. AND YOU CAN YOU CAN PASS THROUGH ON THAT SIDEWALK AND PEOPLE NOT ENGAGE IN THE PROTEST CAN STILL GET TO WHERE THEY NEED TO BE. AND PEOPLE CAN EXERCISE THEIR FIRST AMENDMENT RIGHT. THIS DOES NOT CHANGE THAT AT ALL. THAT'S GOOD TO KNOW THAT JUST BEING CROWDED ON THE SIDEWALK IS NOT DOES NOT CONSTITUTE BLOCKING. THANK YOU. THE OTHER ONE IS THE ANIMAL SERVICES ANIMALS AT LARGE ORDINANCES. AND WHAT THIS DOES IS IT DOESN'T AGAIN CHANGE ANY PROHIBITED BEHAVIOR. CURRENTLY THE ANIMAL AND ALSO THE ORDINANCE RESTRICTING HOW MANY ANIMALS YOU CAN HAVE AT YOUR RESIDENCE. A VIOLATION OF THAT IS A MISDEMEANOR. WHAT THIS ORDINANCE DOES IS MAKES THE FIRST VIOLATION INFRACTION. SO AGAIN IT WOULD BE PUNISHABLE BY A FINE. AND THEN THE SECOND VIOLATION IN A CALENDAR YEAR WOULD BECOME A MISDEMEANOR. IT GIVES US A STEP TO TRY TO GET COMPLIANCE BEFORE WE GO TO THE MISDEMEANOR FOR THIS ONE. IT DOESN'T PROHIBIT ANYTHING NEW, WHICH CHANGES THAT PUNISHMENT SECTION. OKAY. ANY QUESTIONS ON THAT SECTION? CATHERINE. AND THEN THE THIRD ONE IS THE GRAFFITI ORDINANCE. AND AGAIN IN THIS ORDINANCE THERE IS NOTHING NEW THAT WOULD BECOME PROHIBITED. EVERYTHING IN THIS ORDINANCE IS IT'S PROHIBITED IS ALREADY PROHIBITED. WHAT THIS WOULD CHANGE IS TWO THINGS. ONE, IT WOULD ELIMINATE PROVISION ON THE GRAFFITI ORDINANCE THAT THE CITY IS GOING TO GO ON TO PRIVATE PROPERTY AND CLEAN UP PRIVATE PROPERTY GRAFFITI. THE ONUS WAS ALWAYS ON THE PRIVATE PROPERTY OWNER. AND THAT HASN'T HAPPENED FOR A VERY LONG TIME. SO IT TAKES THAT PROVISION OUT. PRIVATE PROPERTY OWNERS WILL BE RESPONSIBLE TO TAKE CARE OF THEIR PRIVATE PROPERTY. THE OTHER THING IT DOES IS IT MAKES THIS. AN INFRACTION THAT HAS THE SAME ESCALATORS ON IT. WITH THE OTHER INFRACTIONS. IT BECOMES A MISDEMEANOR ON THE THIRD VIOLATION HERE. ALL RIGHT, COUNCIL MEMBERS, ANY QUESTIONS? I DO HAVE A QUICK QUESTION. THANK YOU. WHAT WE FOUND WITH WITH VIOLATORS OF THE ANIMAL ORDINANCES, THEY MAY DO IT ONCE OR IT HAPPENS ALL THE TIME. THE RULE IS IN BETWEEN. SO THAT'S WHY IT'S ONCE ON THE ANIMAL ORDINANCE. THEN EVERY FURTHER ONE'S A MISDEMEANOR WITH THE GRAFFITI ONE, YOU KNOW, THIS IS A REQUIREMENT FOR THE PRIVATE PROPERTY OWNER TO CLEAN GRAFFITI OFF OF THEIR PROPERTY. AND WE WANT TO WORK WITH THOSE PROPERTY OWNERS TO HELP THEM GET IT DOWN. IF THERE IS AN ESCALATING FEE WITH THE INFRACTIONS. BUT WITH THAT, WE JUST WANT A LITTLE MORE STEPS TO HELP FOLKS GET THEIR GET THEIR PROPERTY CLEANED UP AND MAKE SURE THAT THEY'RE THAT THEY HAVE WHAT. SO WE'RE SEEING DIFFERENT KINDS OF ESCALATORS.
